Supreme Court Rejects AG’s Bid to Remove Committee Members from CJ Torkonoo Case

The Supreme Court has thrown out a preliminary objection raised by the Attorney-General aimed at excluding several committee members, including Justices Scott Pwamang and Adibu-Asiedu, from a constitutional case filed by suspended Chief Justice Gertrude Torkonoo.

Deputy Attorney-General Dr. Justice Srem-Sai argued that these individuals were not specifically named as respondents and therefore should not be considered parties to the suit. The objection sought to narrow the scope of the case by removing those committee members involved in the proceedings against Justice Torkonoo.

However, former Attorney-General Godfred Yeboah Dame, representing the suspended Chief Justice, contended that the reliefs being sought in the lawsuit were closely tied to the actions of the committee members, making their inclusion necessary.

A five-member Supreme Court panel, led by Acting Chief Justice Paul Baffoe-Bonnie, agreed with Dame's reasoning and dismissed the Attorney-General’s objection. As a result, the committee members will remain part of the legal challenge.

Justice Torkonoo’s lawsuit also includes a request to waive the typical in-camera hearing, a declaration that the committee’s initial findings are unconstitutional, and an injunction preventing the committee from continuing its work. The case is part of a broader legal effort to clarify the constitutional framework governing her potential removal from office.
