AIGS Urges Transparency and Fairness in Chief Justice Torkornoo's Suspension Proceedings

The Africa Institute on Governance and Security (AIGS) has raised serious concerns about the unfolding process to remove Ghana’s Chief Justice, Her Ladyship Justice Gertrude Torkornoo, calling for a fair and impartial investigation.

On April 22, 2025, President John Mahama suspended the Chief Justice following consultations with the Council of State. This action was taken after a prima facie case was reportedly established, prompting the formation of a five-member committee, in accordance with Article 146(6) of the 1992 Constitution, to probe the allegations laid out in a formal petition.

In a statement issued on April 23, AIGS emphasized the importance of ensuring that the proceedings are not only constitutionally sound but also conducted in a transparent and non-partisan manner. The Institute called on all key actors—including the Presidency, the Council of State, and other responsible bodies—to safeguard the integrity of the process.

“We call on all stakeholders…to ensure that the allegations against the Chief Justice are thoroughly and impartially investigated, with full respect for her right to a fair hearing,” said Dr. Palgrave Boakye-Danquah, Executive Director of AIGS. “The process must be transparent, evidence-based, and aligned with constitutional standards to avoid perceptions of politicization or erosion of judicial autonomy.”

While acknowledging that Article 146 provides the legal framework for addressing issues of judicial accountability, AIGS underscored the importance of adhering strictly to due process and the rule of law. The Institute cautioned that any deviation could threaten public trust in Ghana’s democratic institutions.

Reiterating its dedication to strengthening governance and rule of law across the continent, AIGS urged all involved to act in the national interest and uphold the principles of justice, integrity, and judicial independence.

“The independence of the judiciary is essential for democratic governance and the protection of citizens’ rights. Any attempt to remove a sitting Chief Justice must be carried out with the highest degree of integrity and without political interference,” the statement concluded.
